1. General

Welcome to PulsarInteract! These Terms of Use govern your use of the PulsarInteract website and platform (hereinafter referred to as "Service"), which is operated by PulsarInteract GmbH (hereinafter referred to as "we", "us" or "PulsarInteract").

By accessing or using our Service, you agree to be bound by these Terms of Use. If you do not agree with any part of these Terms of Use, you may not use the Service.

2. Definitions

In these Terms of Use, the following terms have the following meanings:

• "User" refers to any natural or legal person who uses the Service.
• "Account"> refers to a registered user account on our platform.
• "Content"> refers to all information, texts, images, videos, graphics, surveys, competitions or other materials that are made available through the Service.
• "Participant"> refers to persons who participate in surveys, competitions or other interactive offers created by users.

In order to fully use our Service, you must register an account. When registering, you must provide truthful, accurate, current and complete information.

You are responsible for maintaining the confidentiality of your account and password and for limiting access to your computer or device. You agree to assume responsibility for all activities conducted under your account or password.

4. Usage Rights and Restrictions

Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable and revocable license to use the Service for your personal or business purposes.

You grant us a worldwide, non-exclusive, royalty-free license (with the right to sub-license), to use, reproduce, process, adapt, modify, publish, transmit, display and distribute your User Content, solely for the purpose of providing and improving the Service.

You warrant and guarantee that:

• You are the owner of the User Content or have all rights, licenses, consents and releases necessary to grant us the above-mentioned license rights to the User Content.
• The User Content does not infringe or misuse the rights of third parties, including but not limited to copyrights, trademarks, privacy, personal rights or other personal or intellectual property rights.

We reserve the right to review and remove User Content that violates these Terms of Use or otherwise is offensive.

6. Privacy

The collection and use of your personal data in connection with the Service is subject to our Privacy Policy.

7. Surveys and Competitions

As a user of our platform, you can create surveys, competitions or other interactive offers. You are responsible for compliance with all applicable laws and regulations in connection with these activities, including:

• Laws and regulations on privacy and the processing of personal data.
• Laws and regulations on competitions, giveaways and prize draws, including specific requirements for participation conditions, age restrictions and the drawing of winners.
• Laws and regulations on youth protection.
• Laws and regulations on combating fraud and money laundering.

We provide you with the technical platform for your activities and are not responsible for the legal conformity of the surveys, competitions or other interactive offers you conduct.

8. Fees and Subscriptions

The use of certain functions of our Service may be subject to fees. The current prices and payment conditions are available on our website.

Subscriptions are automatically renewed unless you cancel before the end of the current subscription period. Cancellation becomes effective at the end of the current subscription period.

We reserve the right to change our prices. Price changes will be announced with an appropriate notice period and apply to the next subscription period.

9. Warranty Disclaimer

Our Service is provided "as is" and "as available", without express or implied warranties of any kind, to the extent permitted by law.

We do not guarantee that the Service meets your requirements, is uninterrupted, timely, secure or error-free, that results obtained through the use of the Service are accurate or reliable, or that errors in the Service are corrected.

10. Limitation of Liability

We are not liable for indirect, incidental, special, consequential or exemplary damages, including lost profits, data loss, goodwill or other intangible losses resulting from your use or inability to use the Service.

Our liability is limited to the amount you have paid us for the use of the Service in the twelve months preceding the event that gave rise to the liability, or, if you are not a paying user, to one hundred euros (100 €).

The foregoing limitations of liability do not apply to damages resulting from the violation of life, body or health, from the violation of a fundamental contractual obligation and from damages arising from intent or gross negligence.

11. Indemnification

You agree to defend, indemnify and hold us harmless from and against all claims, liabilities, damages, losses and expenses, including reasonable attorney and court costs, arising from or in connection with your use of the Service, your User Content or your violation of these Terms of Use.

We reserve the right to change the Service or any part thereof at any time and without notice, to suspend, terminate or limit.

We are not liable for changes, interruptions, settings or limitations of the Service.

We reserve the right to change these Terms of Use at any time and without notice. We will inform you about significant changes by a notice on our website or by email.

Your continued use of the Service after the publication of changes constitutes your acceptance of the changed Terms of Use.

14. Cancellation

We can terminate your access to the Service at any time for any reason, including a violation of these Terms of Use, without notice or liability.

You can cancel your account at any time by contacting us or, if available, using the "Delete Account" function in your account settings.

All provisions of these Terms of Use that should survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnities and limitations of liability, will survive termination.

15. Applicable Law and Jurisdiction

These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods and the international private law.

Exclusive jurisdiction for all disputes arising from or in connection with these Terms of Use is, where legally permissible, Cologne, Germany.

16. Salvatory Clause

If a provision of these Terms of Use is invalid or becomes invalid, the validity of the remaining provisions is not affected.
